Rights and obligations of clients
The rights and obligations of clients for the certification of defense products, works, and services are determined by the current legislation of Ukraine (including the Civil Code and the Commercial Code of Ukraine) and agreements between the Client and the Certification Body.
The Client has the right to:
to receive complete and accurate information about the certification procedure, including requirements, processes, timelines, and costs. The Client must be informed of all necessary documents and requirements before the certification process begins;
to receive high-quality conformity assessment services within the established timeframe;
to be informed in advance about the conditions for conducting certification;
to receive timely information about the results of the certification;
to obtain a certificate confirming the compliance of their product with the requirements of standards or other regulatory documents after successfully completing the certification procedure and signing the agreement for the right to use the certificate of conformity;
to appeal decisions, actions, or inaction of the Certification Body in the manner prescribed by law.
The Client is obligated to:
pay the Certification Body for the work performed in accordance with the concluded agreement;
comply with the certification / conformity assessment requirements;
ensure continuous compliance of the product throughout the validity period of the certificate of conformity;
implement all necessary measures for evaluation and surveillance (if required), including providing conditions for the review of documents and records and access to relevant equipment, locations of divisions, and personnel;
provide necessary information, documentation, and materials required for the certification/conformity assessment of the product;
not use the product certification in a way that would damage the Certification Body’s business reputation and not make any statements about the product certification that could be considered misleading or unauthorized by the Certification Body;
in the event of suspension, cancellation, or expiration of the certificate, cease using any promotional materials that reference the certification / conformity assessment and take the actions required by the certification scheme;
provide other parties with copies of certification documents in their entirety and without changes;
when referencing certification or conformity confirmed by the Certification Body in any documents, media, brochures, or promotional materials, comply with the requirements of the Certification Body or the requirements set forth by the certification scheme;
comply with all requirements regarding the use of the conformity mark and product-related information according to the chosen certification scheme;
maintain records of all known complaints regarding conformity with certification requirements, make these records available to the Certification Body, and take appropriate actions regarding such complaints and any deficiencies, documenting the actions taken;
immediately notify the Certification Body of any changes that may affect the Client’s ability to meet the certification requirements.
